Frequently questions

What is an O-1 Visa?

The O-1 visa is a temporary U.S. work visa for individuals with extraordinary ability in business, science, education, athletics, or the arts, as well as those with extraordinary achievement in the motion picture or television industry. It allows qualified professionals to work in the United States for a specific employer or through a qualifying U.S. agent.

Who qualifies for an O-1 Visa?

You may qualify if you can demonstrate sustained national or international recognition in your field. Evidence may include awards, media coverage, published work, leadership roles, original contributions, judging the work of others, high salary, or other accomplishments that distinguish you from your peers.

Do I need to win a major award to qualify?

No. While internationally recognized awards can strengthen your case, most O-1 applicants qualify by presenting a combination of evidence that satisfies the USCIS eligibility criteria. Every case is evaluated based on its unique facts and supporting documentation.

Can entrepreneurs and business owners apply for an O-1 Visa?

Yes. Entrepreneurs, startup founders, executives, and business leaders may qualify if they can demonstrate significant achievements, industry recognition, innovation, media coverage, or other evidence of extraordinary ability in their field.

Can artists, musicians, and creative professionals qualify?

Yes. Artists, designers, musicians, actors, filmmakers, photographers, content creators, and other creative professionals may qualify if they have achieved distinction through awards, exhibitions, performances, media recognition, commercial success, or other notable accomplishments.

Do I need a U.S. employer to apply?

An O-1 petition must be filed by a U.S. employer or a qualifying U.S. agent. If you work on multiple projects or with multiple clients, a qualifying U.S. agent may be able to file the petition on your behalf.

How long can I stay in the United States with an O-1 Visa?

The initial O-1 visa approval is generally granted for up to three years, depending on the duration of your qualifying work or project. Extensions may be requested if you continue working in the same field of extraordinary ability.

Can my family accompany me?

Yes. Your spouse and unmarried children under the age of 21 may apply for O-3 status to accompany you to the United States. While O-3 dependents may attend school, they are generally not authorized to work.

How long does the O-1 Visa application process take?

Processing times vary depending on USCIS workloads and the specifics of your case. Premium Processing may be available, allowing USCIS to review eligible petitions on an expedited timeline.
